Terms of Service
These Terms of Service (“Terms”) are an agreement between you and DiamondKeeper LLC (“DiamondKeeper,” “we,” “us”) governing your use of the DiamondKeeper app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Eligibility and accounts
- You must be at least 18 years old to create an account. Coaches, administrators, and parents create and manage accounts on behalf of their teams and players.
- Information about players who are minors is added only by an adult who is responsible for the team and has any required parental consent.
- You are responsible for keeping your login secure and for activity under your account.
2. Roles and responsibilities
Coaches and team administrators manage rosters, schedules, and team content. By adding another person’s information (including a child’s), you confirm you have the authority and permission to do so. You agree to keep information accurate and to respect the privacy of everyone on your team.
3. Acceptable use
You agree not to misuse the Service. You will not upload unlawful, harmful, or infringing content; harass or harm others; attempt to access data you are not authorized to see; interfere with the Service’s operation; or use it to violate any law, including those protecting children.
4. Your content
You keep ownership of the content you upload (rosters, stats, photos, video, messages). You grant us a limited license to host, store, and display that content as needed to operate the Service for you and your team. You represent that you have the rights and permissions for everything you upload, including any images of minors.
5. Subscriptions and payments
Some features may require a paid subscription, billed to the team or organization. Prices and billing terms will be shown before purchase. Subscriptions renew unless cancelled, and you can cancel at any time through your account; cancellation stops future charges. Families can follow their own player without charge. Except where required by law, payments already made are non-refundable, though we aim to handle billing issues fairly and make cancellation easy.
6. Our intellectual property
The Service itself — including the DiamondKeeper name, logo, software, and design — belongs to DiamondKeeper LLC and is protected by law. You may not copy, modify, resell, reverse-engineer, or create competing products from the Service.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we handle information, including children’s information.
8. Disclaimers
The Service is provided “as is” and “as available.” While we work hard to keep it reliable, we do not guarantee it will always be uninterrupted or error-free. To the fullest extent allowed by law, we disclaim warranties not expressly stated here.
9. Limitation of liability
To the fullest extent allowed by law, DiamondKeeper will not be liable for indirect, incidental, or consequential damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.
10. Indemnification
You agree to indemnify and hold DiamondKeeper harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or of others’ rights — including claims related to information or images you added without proper permission.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Sections that should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.
